These terms apply to every lesson, rental, storage and service booked with JC Kite School, run by JC Kite Kenya Limited, Garoda Beach, Watamu, Kenya. By booking with us – online, by WhatsApp, by email or at the school – you accept them. In short: we plan the lessons every day around the wind, we need you to confirm your time and to be on time, and if the weather stops a lesson we move it or refund it.
1. Booking and payment
- You can request lessons, rental or storage on our booking page, by WhatsApp, by email or at the school. A booking is confirmed only when we confirm it to you.
- After confirming, we send you a secure payment link. Prices are in euros and are those shown on our website or in our confirmation.
- Before your first lesson or rental we ask for your name, an ID document, your kite level and any health conditions we should know about.
2. How lesson times work
Kitesurfing depends on wind and tide, so we can't fix lesson times weeks in advance. Every day we plan the lessons for the next day around the forecast:
- By about 8 pm we send you the time of your lesson for the next day, usually on WhatsApp.
- You have 2 hours to confirm it. If the time doesn't work for you, tell us within those 2 hours and we'll do our best to rearrange it.
- If we don't hear from you within 2 hours, your slot is released and may be given to another student. We will try to find you another time, but we can't guarantee it.
3. Changes, late arrivals and no-shows
- Once you have confirmed a lesson, you can move it free of charge up to 12 hours before the start time. After that, the lesson can only be moved if we can fill your slot.
- Please be at the school at least 15 minutes before your lesson to get ready.
- Late arrival: the lesson still ends at the planned time, because the next student and the wind don't wait. The time lost is counted as lesson time.
- No-show: if you don't come, or you arrive more than 30 minutes late without letting us know, the lesson is counted as done and is not refunded or moved.
- If you are ill or injured, let us know as soon as possible: with a medical certificate we move the lesson or refund the hours you can't do.
4. Weather
- We decide whether conditions are safe and suitable for your level. If there is too little or too much wind, a storm or any other safety risk, we cancel or stop the lesson.
- A lesson cancelled or interrupted by us for weather is moved to another time, and an interrupted lesson is counted only for the time actually done.
- If it can't be done before the end of your stay, we refund the hours you didn't do.
5. Cancelling your booking
- If you cancel your booking for personal reasons, or leave earlier than planned, the amounts paid are not refunded, except where these terms say otherwise (weather, illness or injury with a medical certificate).
- If we have to cancel a booking for reasons on our side, we refund everything you paid for the services not provided.
6. Rental and storage
- An ID document is required for every rental and is kept until the equipment is returned.
- Rental is for independent riders only. We may ask you to show your level on the water before renting, and we may refuse or stop a rental if conditions or your level are not suitable.
- You ride within the area indicated by our staff and return the equipment at the agreed time, rinsed and complete.
- Damage and loss caused while the equipment is in your hands are charged at the cost of repair or replacement, unless covered by the Material Insurance you bought with the rental. Ask us what it covers before you start.
- Rental packages are not refundable once started. Rental days you can't use because of weather are handled as in section 4.
- We take care of the equipment you leave in storage, but we are not liable for damage or loss of personal equipment, except where caused by our negligence.
7. Safety and your health
- To take lessons or rent you must be able to swim and be in good health. Tell us about any medical condition, injury, pregnancy or medication that could affect your safety on the water.
- Always follow the instructions of our instructors and beach staff, and wear the safety equipment we give you. Our instructors may stop a lesson or a session at any time for safety reasons.
- You may not take lessons or rent under the influence of alcohol or drugs.
- Students under 18 need the written consent of a parent or guardian, who remains responsible for them.
- Kitesurfing is an extreme sport with real risks, even with qualified instructors and good equipment. You take part at your own risk, and our liability is limited to what is allowed by Kenyan law.
- We strongly recommend travel and medical insurance that covers kitesurfing.
8. Privacy
- We collect only the data we need to manage your booking: name, contact details, dates, kite level, ID for rentals, health information you choose to tell us and payment details.
- We use it to organise your lessons and stay, to contact you and to meet our legal and accounting obligations. We use Looply, our booking software, to store bookings; messages from the contact form are sent to us by email.
- We don't sell your data and we share it only with the providers we need to run the service (for example payments, email and accommodation) or when required by law.
- This website doesn't use advertising or tracking cookies.
- Under the Kenya Data Protection Act 2019 you can ask to see, correct or delete your data at any time by writing to hello@jckiteschool.com.
9. Photos and videos
We often take photos and videos on the beach and on the water, and we may use them on our website and social media. If you don't want to appear, just tell us – before or after – and we won't publish, or will remove, the pictures where you can be recognised.
10. Law and contacts
These terms are governed by the laws of Kenya. If something goes wrong, please talk to us first: we always try to find a fair solution. For any question write to hello@jckiteschool.com or on WhatsApp +254 715 905550.
